About the Presentation

HR professionals are an integral part of the team successfully defending a company from employment-related litigation. This seminar will give HR professionals an understanding of the basic and essential elements of typical employment-related litigation facing companies.

Along with written materials which will serve as a handy reference in the future, HR professionals will learn how to have more productive conversations with legal counsel and how to more effectively help defend claims brought by current and former employees:

  • How to avoid employment-related breach of contract and discrimination litigation in the first place.
  • How to properly document employee activity and prepare for litigation before it even occurs.
  • How to investigate a claim of discrimination, breach of contract, or wrongful termination.
  • How to secure and preserve evidence for administrative proceedings or future litigation.
  • How to conduct employee interviews to establish and preserve a record of events.
  • How to implement a "Litigation Hold" to preserve evidence.
  • Introduction to the essential elements of any employment-related litigation and how the litigation process works.
  • Learn litigation lingo.
  • How to answer "discovery" requests such as interrogatories and requests for production of documents.
  • How to avoid liability for answering discovery requests incompletely.
  • Introduction to litigation timelines and important milestones such as the "Motion for Summary Judgment"\".
  • How to work efficiently and effectively with your legal counsel.

Practice Summary

Joe's practice is focused primarily in the areas of employment litigation, labor law, and commercial litigation. He represents clients in state and federal courts and agencies throughout New England in employment matters including executive compensation disputes, non-competition disputes, and matters involving employment-related statutes including Title VII, ADEA, the ADA, ERISA, FMLA and state equivalents.

Joe also represents clients in all facets of labor relations including collective bargaining negotiations, arbitrations and matters before the NLRB. In addition, he represents clients in commercial litigation matters and health care litigation matters.
