This Presentation Will Include:

  1. What types of leave are available to employees;
      
  2. What are the pros and cons of replacing your vacation/sick/personal leaves with a single paid time off (PTO) policy;
      
  3. Addressing leave requests -- how to protect your rights while avoiding employee claims.

This talk will cover issues such as family and medical leave, which are required by law, as well as vacation and personal time provided at the employer's discretion. The presenters will also discuss state and federal leave laws, discrimination, written policies, consistent practices, and use of medical certifications.

About the Speakers

Michael A. Gamboli

  

  
Michael A. Gamboli
represents management in all areas of employment law and related litigation. Chambers USA - America’s Leading Lawyers for Business has consistently recognized Mr. Gamboli as a leading management-side employment attorney and litigator.

Mr. Gamboli advises clients on the potential impact of employment decisions involving employment inquiries, leaves of absence, discipline, potential discrimination and termination.

  
In addition to having over 15 years' experience litigating general business disputes, he has significant experience defending employment discrimination and related claims in Rhode Island and Massachusetts state and federal courts, and before state and federal administrative agencies such as the RICHR, MCAD and EEOC.
  
Mr. Gamboli also has significant experience in the negotiation, drafting and implementation of employment contracts, policies, handbooks and separation agreements, and has defended and prosecuted numerous lawsuits concerning non-competition agreements and trade secrets.

Mr. Gamboli received his J.D., magna cum laude, from Boston University School of Law and his B.S. from Bucknell University. He is admitted to practice in Rhode Island and Massachusetts.

Mr. Gamboli is a member of the Board of Directors of the Greater Providence YMCA, the Special Olympics Rhode Island and the Rhode Island Community Food Bank. He is on the Human Resources Advisory Committee for both the Hockomock Area YMCA and the Rhode Island Philharmonic Orchestra, is a Corporation Member of Memorial Hospital of Rhode Island, is past Chairman of the Regional Board of Directors for the National Kidney Foundation, and is a past Board Member of the Rhode Island Sports Council and the Rhode Island Center for Performance Excellence.
  

  
Michael J. Murray
advises and defends employers in a wide range of employment and labor law cases involving discrimination, sexual harassment, wage and hour claims, Family and Medical Leave Act, disability and accommodation claims, non-compete and employment contract matters and personnel policy issues.

He is experienced in public and private sector collective bargaining, grievances and arbitrations, unfair labor practices and representation elections.

  

Michael J. Murray

 
Mr. Murray is licensed to practice in Massachusetts and Rhode Island and regularly appears in State and Federal Courts and before administrative agencies in both states. He frequently lectures and leads seminars on wage and hour issues and other employment matters.

Mr. Murray is a member of the Board of Directors of the New Bedford Bar Association and is an Employment Law Mentor in its Lawyer Mentoring Program. He is a past member of the City of New Bedford Human Relations Commission and the Bristol County Personnel Review Board. He is on the Board of Directors of the Waterfront Historic Action League (WHALE), New Bedford Rotary Club and Leadership South Coast.

Mr. Murray received his J.D., cum laude, from Suffolk University Law School and his B.A., magna cum laude, in History from Stonehill College
